Please read these Terms of Service carefully before using the services offered by StagerAI. This Agreement sets forth the legally binding terms and conditions for your use of the StagerAI website and all related services, including any features, content, websites (including stagerai.com/) or applications offered from time to time by Stager AI in connection therewith (collectively “Services”). By using the Services in any manner, you agree to be bound by this Agreement.
By using the Service, you agree to all of these Terms of Service, as well as any other operating rules, policies, and procedures that may be published from time to time by StagerAI in connection with the Service. Additionally, certain services offered through the Service may be subject to additional terms and conditions that are incorporated into these Terms of Service by reference. StagerAI reserves the right to refuse the Service to any person or entity and change its eligibility criteria at any time, at its sole discretion. In any jurisdiction where this provision is prohibited by law, the right to access the Service is revoked.
At its sole discretion, StagerAI may modify or replace any of the Terms of Service, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the StagerAI websites or Service or by sending you an email. StagerAI may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability. It is your responsibility to check the Terms of Service periodically for changes. Your continued use of the Service following the posting of any changes to the Terms of Service constitutes acceptance of those changes.
Subject to your compliance with this Agreement, the conditions herein and any limitations applicable to StagerAI or by law:
(i) you are granted a non-transferable, non-sublicensable, non-assignable license to access and use the Service for business or personal use;
(ii) you own all photo editions you create with the Services and we hereby assign to you all rights, title and interest in and to such photos for your personal or commercial use.
(iii) You are fully responsible for your photo editions and we do not take any responsibility of any potential damages caused to your business due to the use of StagerAI.
Otherwise, StagerAI reserves all rights not expressly granted under these Terms of Service. Each person must have a unique account and you are responsible for any activity conducted on your account. A breach or violation of any of our Terms of Service may result in an immediate termination of your right to use our Service.
You agree to indemnify, defend, and hold harmless Tramontana Tech, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys fees and costs, arising out of or in any way connected with your access to or use of Stager AI, including, but not limited to, claims related to copyright infringement or intellectual property rights.
Our default policy is not to issue refunds due to the cost involved in generating images using artificial intelligence. However, we may consider refund requests on a case-by-case basis at our sole discretion. The decision to provide a partial or full refund, if any, will be made by Tramontana Tech.
By uploading images to Stager AI, you retain all rights and ownership of the content you provide. However, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and modify your uploaded images for the purpose of providing our services, ensuring their quality, and enhancing our offerings. This may include using your images in an aggregated and anonymized manner to improve the performance of our artificial intelligence models, without disclosing your personal information. By uploading images, you represent and warrant that you have the necessary rights and permissions to use and share those images in the manner described in these Terms.
We reserve the right to modify or discontinue, temporarily or permanently, any part of our Services with or without notice. We reserve the right to change the pricing structure of our product. We will try to exempt existing customers from those changes. However, we may choose to change the prices for existing customers. If we do so, we will give at least 7 days notice and will notify you via the email address on record. We may also post a notice about changes on our website.
Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis. We take uptime of our applications seriously but do not offer service-level agreements for most of our Services yet. We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. Of course, we will contact the account owner before taking any action, except in rare cases where the level of use may negatively impact the performance of the Service for other customers. You share your data with us when you use our Services. We respect that trust and we only use your data as explained in our Privacy Policy and for no other reason. We rely on some third party providers and hosting partners to supply the essential hardware, software, networking, storage, and related technology needed to run the Services.
StagerAI reserves the right to suspend or ban your access to the Services at any time, and for any reason. You may not use the Services for competitive research. You may not reverse engineer the Services or the Assets. You may not use automated tools to access, interact with, or generate Assets through the Services. Only one user may use the Services per registered account. Each user of the Services may only have one account. We reserve the right to investigate complaints or reported violations of our Terms of Service and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses, and traffic information.
These Terms and your use of Stager AI are governed by the laws of Spain. You agree to submit to the exclusive jurisdiction of the courts of Spain to resolve any disputes arising out of or relating to these Terms.
